Terms of Service

These Terms of Service ("Terms") govern the use of the Burnout mobile application ("App") and the website https://getburnout.app ("Website") provided by Burnout ("we," "us," or "our"). By accessing or using the App or Website, you ("User" or "you") agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the App and Website.
1. Use of the App
1.1 Eligibility
By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you must have parental or guardian consent to use the App.
1.2 No Account Required
The App operates entirely on your device. There are no user accounts, no sign-up, no logins and no passwords. You cannot sign in to Burnout, because there is nothing to sign in to. Your records are not copied to a server, and the App works in airplane mode for as long as you use it.
Some things do leave the device: usage analytics and crash reports go to Google's Firebase, subscription status goes to RevenueCat, and if you enter a promo code the App sends us the code, a random identifier it generated on your device and whether you are on iOS or Android. None of your written entries leave, and our Privacy Policy lists every number that does. Section 3 sets this out in full.
1.3 Acceptable Use
You agree to use the App in compliance with applicable laws and these Terms. You shall not:
- Use the App for any unlawful or unauthorized purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to any associated systems or services
- Interfere with or disrupt the operation of the App
2. Health Disclaimer
Burnout is a quit-smoking tracking tool designed for informational and supportive purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The smoke-free milestones, nicotine clearance timelines, and any health-related content displayed in the App are based on general research and are not tailored to your individual health circumstances.
Always consult your doctor or qualified healthcare professional before or during your quit-smoking journey, especially if you:
- Have a history of heavy or prolonged tobacco use
- Are under 18 years of age
- Have a pre-existing cardiovascular condition, respiratory disease, or other medical condition
- Are taking medication (including nicotine replacement therapies or prescription cessation aids)
- Are pregnant or planning to become pregnant
This App is not a substitute for professional medical advice on quitting smoking. If you experience any concerning symptoms during your cessation attempt — including chest pain, severe anxiety, or other adverse effects — seek medical attention immediately.
Health data tracked within the App (including smoke sessions, smoke-free days, streaks, nicotine clearance progress, and smoke-free milestones) is for personal tracking purposes only and should not be used for medical decision-making without consulting a healthcare professional.
3. Your Records Stay on Your Device
Everything you create in the App — smoke sessions, smoke-free days, nicotine clearance progress, streaks, journal entries, and settings — is written to your device, and the records themselves stay there. We hold no copy of them. We cannot read them, restore them or hand them to anyone, because they never reach us.
That cuts both ways. If you delete the App, wipe the phone or lose it, that data is gone for good. There is no server backup to fall back on, and we cannot recover anything for you.
Export and import are how you carry your recovery to a new phone. In the App's settings, "Export my data" writes a single file holding everything the App knows; you keep that file wherever you like, and "Import data" reads it back in on the new device. The file is yours alone — we never receive it and hold no copy. Exporting before you switch phones, wipe the device or delete the App is your responsibility, and it is the only way back.
Our Privacy Policy sets out exactly what leaves your device: usage analytics and crash reports (Firebase), subscription status (RevenueCat), a promo code redemption if you send one, and the few counts that travel inside analytics events. It also says what never leaves: your journal, notes, reasons, quit date, weight and day-by-day history.
4. Intellectual Property
4.1 Ownership
The App and Website, including all content, features, and functionality, are owned by us or our licensors and are protected by intellectual property laws. All rights, title, and interest in the App remain our exclusive property.
4.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the App for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
5. Privacy
We respect your privacy and are committed to protecting your information. Our collection, use, and disclosure of information are governed by our Privacy Policy, which is incorporated by reference into these Terms.
6. Subscriptions
6.1 Premium Features
The App offers optional subscriptions ("Burnout Pro") that provide access to premium features including detailed history and stats, cessation insights, badges, and more. The free tier stays free for as long as you use it, with no time limit and no card required.
6.2 Billing
We offer monthly, yearly, and lifetime purchase options. You pay the full price when you buy, and premium features unlock straight away. Payment is charged through your Apple App Store or Google Play account once you confirm the purchase, under that store's own terms of sale. Subscriptions renew automatically unless auto-renew is turned off in your App Store or Google Play settings before the current period ends. Burnout has no account of its own, so every part of billing — payment, renewal and refunds — is handled by the store you bought from.
6.3 Cancellation
You can cancel your subscription at any time through your device's subscription management settings (App Store or Google Play). Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until then. The free tier remains fully functional after cancellation.
6.4 Promo Codes
We sometimes issue promo codes that unlock Burnout Pro. Redeeming one is the only time the App contacts our own server: it sends the code, a random identifier generated on your device (the same one RevenueCat holds), and whether you are on iOS or Android, and we answer with what that code unlocks. We keep that record so the code's uses can be counted and so it still works after a reinstall. The App unlocks Pro from our answer, on the device. We do not learn who you are. A code unlocks Pro on the device that redeems it; keep the code and you can redeem it again after a reinstall or on a new phone.
7. Disclaimers and Limitations
7.1 App Availability
We strive to provide a reliable App experience but do not guarantee that the App will always be available, error-free, or free from harmful components.
7.2 Disclaimer of Warranties
The App and Website are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.3 Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use or inability to use the App, even if we have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless Burnout and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the App or violation of these Terms.
9. Changes to Terms
We may update these Terms from time to time. Changes will be indicated by an updated revision date. Continued use of the App after changes constitutes acceptance of the updated Terms.
10. Governing Law
Burnout is provided by Must Have Apps SIA, registered at Valguma iela 18-16, Rīga, LV-1048, Latvia. These Terms are governed by the laws of the Republic of Latvia, without regard to its conflict-of-laws principles. The courts of Rīga, Latvia will have jurisdiction over any dispute, except where mandatory local consumer-protection law entitles you to bring proceedings in the courts of your country of residence.
